Legal Counsel, Southeast Asia

We are looking for a Legal Counsel in South East Asia (SEA) to serve as a strategic business partner providing support for a broad spectrum of legal matters. The SEA Legal Counsel will work as part of a regional legal team of 6 lawyers and will report to the Senior Counsel, South Asia with dotted reporting to the country Commercial Director(s).

LOCATION: Vietnam (Ho Chi Minh) or Thailand (Bangkok)

TRAVEL: Domestic travel may be required up to 20% and international travel may be required up to 10% of time.

KEY DUTIES AND RESPONSIBILITIES:

Be a proactive, agile, and commercially-minded business partner to internal stakeholders.
Drafting, reviewing, negotiating or otherwise providing legal support to the various types of contracts and commercial transactions arising from the fast-growing business of Align Technology in Vietnam, Thailand and other SEA markets.

Providing support in reviewing marketing proposals and collaterals and educating marketing team to ensure compliance with local laws, regulations and codes which apply to medical devices in the field of advertising, promotion and labelling.
Providing general support in other legal and regulatory aspects of the activities of Align Technology in Vietnam, Thailand and other SEA markets, such as trademark enforcement and brand protection, anti-bribery compliance, anti-trust issues.
Monitoring major legislative developments and regulatory changes that is relevant to Align Technology and updating legal and commercial teams accordingly.
Counsel, advise and train on general corporate legal and compliance matters.
Ensure compliance with Align’s contract management process, along with company policies and procedures.
Provide support to audit processes and quality management system as required
The role will focus primarily on Vietnam and/or Thailand, with a view to expanding and taking on a wider regional focus across other SEA markets over time.

QUALIFICATIONS & EXPERIENCE:

LL.B, J.D., or equivalent with strong academic credentials from a leading overseas or national university.
6+ years of relevant legal experience in medical technologies, pharmaceuticals or other life science business at a law firm, in-house, or combination of both.
Experience working in a global, multinational company. Experience of managing legal matters in Vietnam or Thailand is a must. Experience related to other markets in South East Asia is a plus.
Experience with and strong working knowledge of applicable commercial legal principles.

SKILLS AND ABILITIES:

A pleasant personality with good interpersonal skills, including, but not limited to, a positive attitude and sense of humour!
Fluency in English and Vietnamese or Thai, together with excellent drafting skills in spoken languages.
Experience in contracts, distributorship, public tender process, sales support, other commercial activities and general corporate matters required.
Experience in medical device, pharmaceutical, or other healthcare sectors strongly preferred.
Experience in advertising and promotion compliance (especially, consumer-facing marketing), brand protection and trademark enforcement, and anti-bribery compliance preferred.
Demonstrable ability to think and act independently, as part of a wider legal team.
Strong verbal and written communication skills and ability to communicate effectively with a broad audience including legal, business, marketing and highly specialized technical individuals.
Ability to multi-task, prioritise work and perform in a very fast-paced, highly customized business environment across markets.
Strong work ethic with a commitment to ensure that all deadlines are met on time and with a high degree of quality.
Ability to frame, draft and negotiate both routine and bespoke agreements.
