Job Description
Activision Blizzard is seeking an experienced IP counsel to join the AB in-house legal team to manage intellectual property and brand protection efforts in China and other parts of the APAC region. This position also involves supporting IP transactions, managing our regional IP portfolio and providing IP counselling and reviews for our go to market, consumer products, and game development teams. This position is based in Shanghai, and reports to the Senior Director, Regional Legal Affairs (Greater China, South Asia, ANZ).
The ideal candidate is globally minded with substantial in-house and/or law firm experience working for MNCs and interfacing with overseas counterparts. The successful candidate will be responsible for closely partnering with the business and offering counsel for internal stakeholders on all aspects of intellectual property including IP enforcement, IP strategy, asset clearance, legal risk assessments, due diligence, while also drafting and negotiating a wide variety of agreements.
Responsibilities
Manage day-to-day aspects of IP and brand protection activities in China including drafting and sending takedown notices and cease and desist letters
Support HQ Trademark Team on trademark registry and prosecution matters in China, as well as advise on regional IP portfolio strategies.
Receive and investigate reports of suspected infringement; Analyze and recommend appropriate enforcement actions
Develop proactive recommendations and plans to prevent infringing activities and to improve the efficiency of remedial actions
Manage law firms, investigators, IP protection vendors and local partners to handle infringement cases
Manage relationships with key channels such as app stores, online video platforms and e commerce websites to improve takedown results
Provide legal review, risk assessment and clearance of art assets and other content.
Review software licenses
Draft and negotiate commercial agreements with substantial IP components
Remain up to date on emerging legal trends and changes within the region.
Also support IP and brand protection efforts in other APAC territories as needed
Requirements
Fluent in Mandarin Chinese and English
5+ years’ experience in IP litigation or brand protection, from a private law firm servicing international clients and/or at a multi-national corporation (preferably with experience in IP heavy industries such as video games, film, television, music, sports or other entertainment or media).
Law degree from a recognized law university or equivalent legal education. Preferably a PRC law degree with an LLM or JD from an overseas law school.
Qualification to practice law in China and/or US.
Experience with PRC trademark law and copyright law is essential.
Familiarity with open-source software licenses
Proven track record on working with outside agents, law firms and enforcement authorities in China
