Job Description

  • Manage outside counsel in the filing, prosecution and enforcement of trademarks in APAC.
  • Manage and conduct trademark searches, clearances, oppositions, cancellations, invalidations.
  • Work with our Brand Protection Manager on counterfeit matters and customs recordation.
  • Give trademark related trainings to the business units, especially the Motorparts, to improve awareness.
  • Negotiate, draft, and review licensing, co-existence and other trademark related agreements with customers, suppliers, service providers and third parties.
  • Advise on IP-related contract enforcement, contract disputes, supplier quality matters and contract terminations and transitions.
  • Negotiate, draft and review marketing agreements, sponsorship agreements, agency agreements, services agreements and event agreements, among others.
  • Pre-publication collateral review; advise as to domains, e-commerce and social media.
  • Advise on rights of privacy/publicity and unfair competition law.
  • Support Trademark issues in M&A assessments and negotiations.
  • Assist with IP litigation.

Required Skills

  • PRC Bar is a must.
  • 5-10 years of trademark experience in areas including filing and prosecution, portfolio management, clearance searching and licensing and enforcement with an in-house law department or a law firm.
  • Familiar with trademark law, advertising law, product quality law and anti-competition law in China.
  • Strong interpersonal skills, including the ability to establish effective working relationships with the team members of the law department and internal clients in APAC.
  • Hard working, well organized and able to manage numerous projects simultaneously under deadline pressure.
  • Excellent oral and written English
